1. About BookPing

BookPing is an automated appointment reminder service that sends SMS, WhatsApp, and Email notifications to your clients before scheduled appointments. BookPing is operated by BookPing ("we", "us", "our").

2. Eligibility

You must be at least 18 years of age and have the legal authority to enter into this agreement to use BookPing. BookPing is intended for use by businesses and professionals, not individual consumers.

3. Your Account

You are responsible for maintaining the security of your account and all activities that occur under your account. You must provide accurate and complete information when creating your account. You must notify us immediately at hello@bookping.co if you suspect any unauthorised use of your account.

4. Subscription and Payment

• BookPing is offered on a monthly subscription basis at the pricing tiers displayed on our website.
• Subscriptions begin after any applicable free trial period ends.
• Payment is processed securely by Paddle, our payment provider.
• Subscriptions automatically renew each month unless cancelled.
• You may cancel your subscription at any time from your account settings or by contacting us.
• We reserve the right to change our pricing with 30 days' notice to existing subscribers.

5. Free Trial

BookPing offers a free trial period (7 days for Starter, Growth, and Pro plans; 14 days for Enterprise). No charge is made during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and your payment method will be charged.

6. Acceptable Use

You agree to use BookPing only for lawful purposes and in accordance with these Terms. You must not use BookPing to:

• Send spam, unsolicited messages, or harassing communications.
• Send messages that are illegal, fraudulent, or deceptive.
• Violate any applicable messaging laws or regulations (including GDPR, TCPA, or equivalent).
• Impersonate any person or entity.
• Interfere with or disrupt the BookPing service.

You are solely responsible for obtaining any necessary consent from your clients to receive automated reminders. BookPing is a tool — you are responsible for how you use it.

7. Service Availability

We aim to provide BookPing with maximum uptime. However, we do not guarantee uninterrupted, error-free service. Scheduled maintenance, third-party service outages (such as Twilio or Zapier), or events beyond our control may occasionally affect service availability.

8. Intellectual Property

All content, branding, and software associated with BookPing remain the intellectual property of BookPing. You may not copy, reproduce, or distribute any part of BookPing without our prior written consent.

9. Limitation of Liability

To the fullest extent permitted by law, BookPing shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months prior to the claim.

10. Termination

We reserve the right to suspend or terminate your access to BookPing at any time, with or without notice, if you violate these Terms. You may terminate your account at any time by cancelling your subscription and contacting us.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Kenya. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by email. Your continued use of BookPing after changes take effect constitutes your acceptance.
